1. Introduction
These Terms and Conditions (“Agreement”) govern the provision of services by Nexus SureHost (“Company,” “we,” “us,” or “our”) to you (“Client,” “Customer,” or “User”). By using our services, you agree to abide by these terms. If you do not agree, please discontinue use of our services.
2. Services Provided
2.1 Website Design & Development
- We provide website design services, including but not limited to UI/UX design, development, and implementation.
- Clients must provide necessary content, images, and branding materials before the project begins.
- Once a project is completed and approved, additional changes will incur extra charges.
2.2 Shared Hosting
- Hosting services are managed via CyberPanel with allocated resources per the service plan.
- Clients are responsible for maintaining backups of their data. We are not liable for data loss.
- Fair usage limits apply to ensure performance for all users. Abuse of system resources may result in service suspension.
- Clients may not use shared hosting for illegal activities, spam, or malicious software.
2.3 VPS Hosting
- VPS hosting includes dedicated resources based on the selected plan.
- Clients are responsible for managing their VPS, including security, software updates, and backups.
- Excessive bandwidth usage beyond plan limits may result in throttling, additional charges, or suspension.
2.4 Nexus Software Portal
- We provide a white-labeled business management solution under the Nexus Portal.
- Features include CRM, project management, invoicing, marketing automation, and business tools.
- Clients may not resell, sublicense, or misuse the software unless explicitly permitted.
- Clients are responsible for securing their accounts. We are not liable for breaches due to weak passwords or misconfigurations.
3. Payment & Billing
3.1 Payment Terms
- Payments are processed securely via Stripe on a monthly or yearly basis, based on the selected billing cycle.
- Services will be suspended if payment is overdue by 7 days and terminated after 30 days of non-payment.
- A $25 reactivation fee may apply for suspended accounts.
3.2 Refund Policy
- Website Design Services: Non-refundable once work has commenced.
- Hosting Services: 30-day money-back guarantee for new subscriptions (excludes renewals).
- Nexus Software Portal: No refunds once the account is set up and active.
4. Acceptable Use Policy (AUP)
Clients may not use our services to:
✅ Host or distribute illegal content, malware, spam, or phishing attacks.
✅ Engage in hacking, DDoS attacks, or unauthorized access to networks.
✅ Use hosting resources in a way that negatively impacts other users.
✅ Violate copyright laws by distributing pirated software, media, or data.
🚨 Violation of AUP may result in immediate service suspension or termination without a refund.
VPS clients are responsible for ensuring their servers are secure and not used for illegal streaming services, botnets, or abusive activities.
5. Data Security & Privacy
🔒 We take industry-standard security measures to protect client data. However:
- We are not responsible for data loss due to hacking, misconfiguration, or third-party breaches.
- Clients must use strong passwords and security settings for their accounts.
- Clients must maintain regular backups of their data.
6. Service Availability & Uptime
- We guarantee 99.9% uptime for VPS hosting (excluding scheduled maintenance).
- Shared hosting uptime depends on server loads and network stability.
- Maintenance windows will be communicated in advance.
7. Termination & Cancellation
7.1 Client Termination
- Clients may cancel services anytime via the Client Portal.
- Refunds are subject to the refund policy in Section 3.2.
7.2 Company Termination Rights
We may suspend or terminate services if a Client:
❌ Fails to make timely payments.
❌ Engages in illegal or abusive behavior.
❌ Violates these Terms & Conditions.
8. Limitation of Liability
- We are not liable for indirect, incidental, or consequential damages related to service interruptions.
- Our maximum liability for any claim shall not exceed the amount paid by the Client for services in the last three (3) months.
9. Governing Law & Dispute Resolution
This Agreement shall be governed by the laws of Florida, USA, without regard to conflict-of-law principles.
Disputes shall be resolved exclusively in state or federal courts located in Hillsborough County, Florida. Clients waive objections to venue and jurisdiction in these courts.
10. Amendments & Updates
We reserve the right to modify these Terms & Conditions at any time. Clients will be notified of significant changes via:
